Lakota Indians Withdraw Treaties Signed With U.S. 150 Years Ago

Lakota Indians Withdraw Treaties Signed With U.S. 150 Years Ago

Thursday, December 20, 2007

WASHINGTON — The Lakota Indians, who gave the world legendary warriors Sitting Bull and Crazy Horse, have withdrawn from treaties with the United States.

"We are no longer citizens of the United States of America and all those who live in the five-state area that encompasses our country are free to join us,'' long-time Indian rights activist Russell Means said.

A delegation of Lakota leaders has delivered a message to the State Department, and said they were unilaterally withdrawing from treaties they signed with the federal government of the U.S., some of them more than 150 years old.

The group also visited the Bolivian, Chilean, South African and Venezuelan embassies, and would continue on their diplomatic mission and take it overseas in the coming weeks and months.

Lakota country includes parts of the states of Nebraska, South Dakota, North Dakota, Montana and Wyoming.

The new country would issue its own passports and driving licences, and living there would be tax-free - provided residents renounce their U.S. citizenship, Mr Means said.

The treaties signed with the U.S. were merely "worthless words on worthless paper," the Lakota freedom activists said.

Withdrawing from the treaties was entirely legal, Means said.

"This is according to the laws of the United States, specifically article six of the constitution,'' which states that treaties are the supreme law of the land, he said.

"It is also within the laws on treaties passed at the Vienna Convention and put into effect by the US and the rest of the international community in 1980. We are legally within our rights to be free and independent,'' said Means.

The Lakota relaunched their journey to freedom in 1974, when they drafted a declaration of continuing independence — an overt play on the title of the United States' Declaration of Independence from England.

Thirty-three years have elapsed since then because "it takes critical mass to combat colonialism and we wanted to make sure that all our ducks were in a row,'' Means said.

One duck moved into place in September, when the United Nations adopted a non-binding declaration on the rights of indigenous peoples — despite opposition from the United States, which said it clashed with its own laws.

"We have 33 treaties with the United States that they have not lived by. They continue to take our land, our water, our children,'' Phyllis Young, who helped organize the first international conference on indigenous rights in Geneva in 1977, told the news conference.

The U.S. "annexation'' of native American land has resulted in once proud tribes such as the Lakota becoming mere "facsimiles of white people,'' said Means.

Oppression at the hands of the U.S. government has taken its toll on the Lakota, whose men have one of the shortest life expectancies - less than 44 years - in the world.

Lakota teen suicides are 150 per cent above the norm for the U.S.; infant mortality is five times higher than the U.S. average; and unemployment is rife, according to the Lakota freedom movement's website.

Hey Voxxy, I hope this story is true. Good for them.

All the Indians were treated badly by our government. My Cherokee ancestors were driven from there homes, at which time they had there own newspaper and courthouse. I will always feel for the Indians and there demise. If the red man had won and retaken the land then the USA would be a much better place than it is today. I truly believe that.

I wish I could live there instead of this America - which has become a place I don't feel all that comfortable in anymore (and sometimes fear). You shouldn't fear your own freakin government.....

I wish this story was being given more attention in the press. I've been trolling for articles about it, but can't seem to find detailed stories in papers other than USA Today and Fox. I don't really trust those sources...if anyone has more details, I would love to read something more in-depth...

Now there's an interesting concept. People always talk about absorbing Canada into the States and I can tell you there is not likely even one Canadian that would want to do that. But take some American states into our fold? Hmmm... Not sure either side would want that either. Canadian government, laws and culture have similarities to yours, but there are some fundamental differences too. Hmm... bears pondering.

I know lots of Americans that would love to be part of Canada.
Posted on 12:19PM on Dec 22nd, 2007
Yeah, there are lots and lots and lots that would.

I used to have a friend who is part of the Lakota nation. He talked sometimes about his tribe not being part of the US. I wonder if he will move back up there now.

Thanks for taking a look at this everyone. It is true it is not being widely publicized. Why? Well why would the powers that be want a trend like this to be set fourth in motion..? I felt the same about our shameful state of affairs with our less than efficient media. So what did I do? What can we all do? Let your voice be heard, thats what. Blog it. Call your local news stations, and let them know what you want ( i do this year round ) lol. Tell your mom, tell your neighbor, hell tell the grocery store clerck while on your weekly rounds.. Just open your mouth. Word of mouth is like wildfire. So far i've kept politics out of this blog, but i can't seem to help myself here, it's just too great. I am an activist in my day, to day life, and I think it is all our duty to watch out for, and Most importantly ACT for, our falling nation.

Lakotah Unilateral Withdrawal from All Agreements and Treaties with the United States of America We as the freedom loving Lakotah People are the predecessor sovereign of Dakota Territory as evidenced by the Treaties with the United States Government, including, but not limited to, the Treaty of 1851 and the Treaty of 1868 at Fort Laramie. Lakotah, formally and unilaterally withdraws from all agreements and treaties imposed by the United States Government on the Lakotah People. Lakotah , and the population therein, have waited for at least 155 years for the United States of America to adhere to the provisions of the above referenced treaties. The continuing violations of these treaties’ terms have resulted in the near annihilation of our people physically, spiritually, and culturally. Lakotah rejects United States Termination By Appropriation policy from 1871 to the present. In addition, the evidence of gross violations of the above referenced treaties are listed herein. Lakotah encourages the United States of America, through its Government ,to enter into dialogue with Lakotah regarding the boundaries, the land and the resources therein. Please contact the Lakotah Interests Section, Naomi Archer, at (828) 230-1404 or info@Lakotafreedom.com. Should the United States and its subordinate governments choose not to act in good faith concerning the rebirth of our nation, we hereby advise the United States Government that Lakotah will begin to administer liens against real estate transactions within the five state area of Lakotah. Lakotah, through its government, appointed the following representatives to withdraw from all the treaties with the United States of America based on the Vienna Convention on the Law of Treaties entered into force in 1980 and the U.N. Declaration on the Rights of Indigenous Peoples 2007:

I still can't believe the major media is just....IGNORING this? WTF man? Don't move to Canada people. We need to FIX this. This is OUR country, time to take it back from the ******** and slimeballs that are (and have been) using it as their own personal piggy bank/toilet for too many years. Get involved! Leaving is too easy. By leaving, you doom the rest of your countrymen/women to 200 more years of this shite. Stand up! God DAMN it, won't anyone stand the hell UP??

Good point Celainn. It used to be that if we made enough concrete noise in the street that the press would cover it around the world. With the press under fascist control, the people who need to hear this story and the history behind it will never hear it. I want to be able to take a nonviolent stand against this kind of thing, but even that has become a way to get thrown into Guantanamo, indefinitely. I have some American Indian ancestry...I'm not sure what to do. I've stood up against riot police before, but this could get way uglier than that. I am open to ideas, though.

I don't know, T, but I think it has to do with numbers. What government seems to take notice of is sheer VOLUME of dis-satisfaction. One person, 10 people, even 100 people, yer right, they get sent quietly away. But the other thing government respects is money. Maybe a combination of a BIIIIG demonstration and a country-wide boycott of some sort would work? I don't know.... We are sheep, though, all of us. If we look about us and see our neighbors doing nothing, we do nothing. There's GOTTA be a way to show OUR government that we want change. I'll have to think about it.....

I'll think too Celainn.

I interviewed members of the American Indian Movement last year and this issue was mentioned. Maybe I can find the interview and post it again.... The reservations where the Lakota reside are bleak poverty stricken wastelands and the Paha Sapa {Black Hills} no longer are theirs according to the treaties. This is their holy ground, but as soon as gold was discovered there..... * SIGH *
Feeling blessed

I wish them luck, and fear for them.

I am not sure which way this will turn out or of it will work.... the way america has evolved... neither canada nor the states allow for our first people to keep anything they had. My grandfather was french indian (metis) and I have seen what the ontario government is doing to some here... first they take land, then they "set aside" some.. then, they decide they want to take it back and make a golf course.... gee I wonder why they are angry... I wish them the best... I hope it works.
